Landlord entered my rented home without my permission.?

  • This is what I copied from the Virgina landlord tenant laws......


    The landlord may enter the dwelling unit without consent of the tenant in
    case of emergency. The landlord shall not abuse the right of access or use it to harass the
    tenant. Except in case of emergency or if it is impractical to do so, the landlord shall give
    the tenant notice of his intent to enter and may enter only at reasonable times. Unless
    impractical to do so, the landlord shall give the tenant at least 24 hours notice of routine
    maintenance to be performed that has not been requested by the tenant.


    My landlord entered the home to clean out the furnace that he does routinely every year. All other times I was home when he did this, but this time, I wasn't home and he came inside anyway with his key without any notice. What can I do about this? This wouldn't be considered an emergency like stated above in VA. laws is it?


  • No, cleaning the furnace (routine maintenance) is not classified as an emergency. He should have notified you that he was planning on entering your home. He is in violation of the tenant rights.


  • Talk to him ā ¦his intentions were not malicious, although he was wrong.
    Donā ™t be confrontational, but express the fact that you would appreciate notice before hand. You might consider the words ⠜I feel violatedā  if the situation presents itself.
    If you try to pursue any legal action he could embellish his actions to indicate an emergency ā ¦in other words he could lie.


  • There is no reason your landlord couldn't give you notice. If it is routine, he knew it was coming and it was not impractical to notify you.

    I guess now it depends on what you want to do. Confront him on it, perhaps, and also consult a lawyer if you want to break your lease. You have legit grounds to do so, as he's broken your contract.


  • On the bright side, your furnace was cleaned, and you will most likely have heat this winter. When I lived in an apartment, I put the chain on the door every night. One morning maintenance people came to work on something, with no notice (in Virginia). It was early, I was in bed, and I did not get up to let them in. I could hear them fussing, but too bad! With some notice, I could have been prepared.

    Let the landlord know that you have a right to be notified when he is coming over for maintenance. Sometimes they forget to call in advance; I'll bet that's all it was. Probably realized it was getting cold, and thought he'd better get the furnace attended to, and today was a good day.

    Be happy he cleaned the thing out so you don't have to spend more money on the heat.

  • yes in sure you can get a lawyer and sue your landlord for the ability to break your lease. but is this really worth having to move over? im sure he was trying to do something nice and figured you have always been home before but he didnt find you at home this time. so when he was at your building doing the rest of the check overs, he just did yours too. most landlords have to pay to get this done and he was trying to save himself some money and also it will save you money too by having a furnace run properly it is more efficient.
    so you should talk to him but not confront him, just be nice and let him know the next time you would like to get a call or a note when he plans on doing more things like that.
    i can understand how you feel but do we really need to sue over this? i bet you have better things to do then to go to court and then have to move to a new apartment.
